1.1 The following
definitions apply in these terms &
conditions
WarsawStagNights.com
is a website owned and operated by Travel
Addict, Travel Addict will be referred to as
TA from here onwards.
Travel Addict is a privately owned Polish business, an officially registered and licensed tour operator.
Client means an
individual using the services of TA. Clients
must be at least 18 years old as of their
scheduled date of arrival in Poland.
Group means the
organised group of Clients that is
represented by one Leader.
Leader (leader of the
Group) means an individual or a legal person
making the reservation on behalf of a group
of Clients. The Leader is responsible for
all communication between TA and Group
members.
Tour means the set of
Activities and Services purchased from TA by
the Group
Activity means all
bookings made by TA with its Suppliers in
respect of sporting activities, clubs,
restaurants, performers and ticketed events
Services mean the
booking of Accommodation and provision of
in-country transportation
Accommodation may
comprise either a hotel or a furnished
apartment.
Supplier means any
third party provider of services
1.2 Conclusion
of the contract
This agreement is
effective and shall come into force when TA
provides the Client with its acceptance of
the reservation by e-mail, upon acceptance
of the reservation the Client will provide
TA with credit/debit card payment details or
pay by international bank transfer to TA's
account. This is unless specified otherwise
or unless different arrangements are agreed
upon in a specific case.
The confirmation e-mail
shall include detailed information and
documentation relevant to the Client's
order, the price calculation and the term in
which the payment is due. The Client is
responsible for checking the accuracy of all
the details of the order as described in the
confirmation e-mail, because subsequent
complaints shall not be accepted and TA
shall not be liable for any loss or damage
arising from the negligence of the Client.
If payment is not
received in the term set out in the
confirmation e-mail, TA reserves the right
to cancel the Client's Tour and to withdraw
from the contract.
Since all Services and
Activities are provided by TA's Suppliers,
TA is not responsible for their actual
availability. Only upon receiving the full
payment from the Client, shall TA confirm
all the relevant bookings with the
Suppliers.
Should TA be unable to
make the Tour arrangements as ordered by the
Client in the reservation, TA shall inform
the Client immediately and offer alternative
arrangements. In the circumstances where
there this would result in a substantial
change to the Client's order and/or it would
result in a price change to the Tour, the
contract shall be concluded upon either
payment of the new price or lack of notice
of cancellation, which shall be deemed to
mean the Client's consent to the change to
the order.
TA reserves the right to
make minor changes to the arrangements set
out in the Client's order, provided that
this would not affect the price and the
quality of the Tour. TA will inform Client
as soon as possible of any such changes
(this would include e.g. the change of a
Supplier or time schedule).
TA also reserves the
right to change or to cancel a Service
should it fail to comply (through the fault
of the Supplier) with the safety, hygienic
or other standards required by Polish
legislation in force. In these circumstances
TA shall reimburse the relevant portion of
the price to the Client.
Upon the acceptance of
these terms and conditions the Client is
also obliged to follow the terms and
conditions of TA's Suppliers when using the
Services or participating on the Activities.
1.3 Safety
All members of the Group
must adhere to the rules of venues and
activities. Participation in certain
Activities contained in our programmes may
be subject to height, weight and health
restrictions. Group members must advise
Supplier(s) of any medical circumstances
that may affect their safety or health
whilst participating. Furthermore,
Activities comprising or including an
element of driving or shooting may not be
accessible to intoxicated or unfit people as
determined by the relevant Supplier, before
or during the Activity. Participation in the
itineraries featured by TA is at the
participators’ risk and adequate insurance
cover should be obtained for all members of
the Group.
1.4 Liability
TA shall not be held
responsible for any shortcomings in Services
and Activities that cannot be influenced by
TA, such as weather, traffic, restrictions
imposed by the government during the tour
and any other unforeseen circumstances. The
Client may not raise any claim on the basis
of circumstances that were known to the
Client before the tour.
Planned transportation
times may be extended due to unforeseen
circumstances, such as weather conditions or
road traffic problems. In this situation the
Client is not entitled to compensation for
the waiting time, or for the unused Services
related to the Tour, or to a withdrawal from
the Tour contract due to the delay of the
means of travel.
TA shall not be held
responsible for any eventual discrepancies
or exclusion from transportation caused by
the failure of the Client to observe the
terms and conditions of transportation.
TA shall not be held
responsible for damages which were not
caused by TA or its Suppliers, but which
were caused by the Client, or by a third
person not related to the provision of the
Tour, or by events that could not be
prevented even with maximum care and
attention or for damages caused by unusual
or unforeseeable circumstances.
TA will not be liable for
costs the Client may incur, or failure of
the Client to arrive at ground arrangements
as a subsequence of a flight delay or
cancellation, nor will we be liable for
providing a refund in such circumstances.
1.5 Insurance
TA does not provide any
insurance, unless otherwise stated. Clients
must take out adequate travel insurance for
their trip based on the planned Activities
and ordered Services. In addition to the
medical and personal possessions cover this
should include, this may also provide trip
cancellation cover. If a refund is not
possible within the terms and conditions
above and the Client has travel insurance,
we are happy to provide a letter that will
help claim for the cancellation. TA reserves
the right to cancel this contract or any
particular Service/Activity without refund
or the right for an indemnity in cases where
the Client is not insured in respect of all
risks arising or associated with this
contract, Service or Activities. Please
note that some of the Activities are
qualified by insurance agencies as risky or
highly risky.
1.6 Accommodation
TA is not liable for any
loss or damage related neither to the
accommodation, nor for the availability and
conditions of the accommodation itself. The
Client agrees to settle with the
accommodation management any extraordinary
expenses arising from specific accommodation
services or damage (including loss) on the
accommodation property. It should be
required to submit on request of the hotel
management a valid credit card with
authorisation to the payments mentioned
above. If the Client does not provide such
an authority, TA reserves the right to
cancel the booking and the Client may not be
granted permission to use the accommodation
services.
The Client should
deposit to the accommodation safe/security
box (if available) all credentials,
jewellery or any other valuable property.
The Client is obliged to
follow the terms and conditions of the
accommodation valid in the particular
accommodation.
1.7 Price and
Payment Conditions
Payment to be made in
advance by paypal, credit/debit card or
international/domestic bank transfer, 25%
prepayment at the time of booking and full
payment no later than 30 days in advance of
arrival. If less then 30 days to the
activity then full payment must be made at
the moment of booking by paypal, or
credit/debit card. Any other payment method
must be agreed in writing first with TA.
1.8 Cancellation
Cancel within 5 days of
making a booking and incur no cancellation
fees, provided this is more than 30 days
before arrival.
After 5 days of making a
booking and up to 30 days before arrival,
cancellations and alterations incur an
administration fee of 40PLN per Client per
Service or Activity.
Within 30 days of arrival
there will be no refunds. Clients are liable
for the full cost of the Tour if a
cancellation takes place and payment has not
already been taken already, we will deduct
the full amount due from the credit/debit
card used for reservation. These conditions
also apply if you fail to show up. Minor
alterations may be possible, but this is
solely at our discretion and depends on our
agreement with the operator of the service
or activity.
1.9 Clients’
Obligations to TA.
Clients must comply with
these Terms & Conditions. Non compliance
will be deemed as a cancellation by the
Group of all the arrangements provided by
TA.
The person placing the
reservation and completing the booking will
be the Leader for the duration of the Tour.
The Leader will be our point of contact for
the Group and members of the Group accept
that the Leader has the authority to deal
with us on behalf of every member of the
Group. To avoid confusion, we will not
normally enter into discussions with any
other member of the Group. If for any reason
there is a change of Leader, please notify
us immediately, and we will not accept any
change until we have received confirmation
in writing. The Leader is liable for payment
of the invoice and therefore is responsible
for collecting all monies from the Group and
for making all payments to TA by the due
date. The Leader accepts full responsibility
for paying for all the Clients on the
booking and indemnifies TA against losses
arising from failure of a Group or
individuals within the Group to pay. The
Leader is responsible for ensuring that all
members of the Group know about and adhere
to the terms and conditions.
Once the Group arrives at
the destination the Group undertakes to
behave in a responsible manner and without
risk to the health and safety of the Group
or others. The Group will comply with every
reasonable instruction or request of the TA
representative or agent or Supplier(s). If
any member of the Group fails to do so then
that member of the Group shall be deemed to
have cancelled the Tour arrangements with
immediate effect for the Group. If the Group
are more than 30 minutes late in meeting the
TA representative at the agreed place and
time for a scheduled Activity, then each
member of the Group will be deemed to have
cancelled the activity.
The Client will be
personally liable for any damage occasioned
by the Client to the property or person of a
third party. It is the Client’s
responsibility to obtain all necessary
travel documents and medical advice with
respect to the Tour destination. The Client
should be in possession of a valid passport
and visa (if appropriate). The Client should
also check with a doctor as to whether
vaccinations or additional health
precautions may be required.
When booking a Tour with
TA, it is the Leader's responsibility to
ascertain whether any member of the Group
suffers from an existing medical condition
or disability and to notify TA accordingly.
If such information is not disclosed to TA
until after the holiday voucher has been
issued and, in the opinion of TA, the
condition or disability would render the
Tour arrangements unsuitable or unsafe for
the member of the Group so affected, then
that member of the Group shall be deemed to
have cancelled the Tour arrangements.
1.10 Privacy Policy
TA saves Clients’
personal data according to the relevant
Polish legislation: the Personal Data
Protection Act of 29.08.1997. The Client
agrees that it can be used for marketing
purposes, however TA is not entitled to
provide this data to any third party. The
Client is entitled to ask for his/her
personal data to be changed or deleted.

Notice
Unless otherwise stated,
copyright and any other rights in material
displayed on this website are the sole
property of TA. Website visitors are
permitted to print and download extracts
from this site on the following basis:

1.12 Claims and
Complaints
The Client should report
all complaints related to the provision of
services in writing to TA as soon as
possible. TA agrees to do everything in its
power to make sure that the situation is
remedied to the Tour standard.
If the Client claims a
full or partial refund in respect of
Activities or Services which were not
provided at the agreed standard then the
Client shall formulate its claim in writing
indicating all relevant information and
deliver it by fax or by mail within 14 days
from the date the claim was raised. TA shall
inform the Client about the claim resolution
within 30 days from the delivery of the
claim.
In the case of a
substantiated claim TA shall refund to the
Client the difference between the provided
and agreed Activities or Services. TA shall
not refund any of the Client's expenditures
caused by the Client's failure unless TA
approved them in advance.
